Congressman John Joyce, M.D. (PA-13) has announced his intention to introduce legislation aimed at overturning a decision by the Biden Administration that permits California to ban the sale of new internal combustion vehicles. This move follows a waiver granted in December 2024, which allows California's electric vehicle mandate to proceed.

"The Biden Administration’s 11th hour decision to approve a de facto nationwide ban on the sale of gas-powered automobiles and hybrids is exactly why the Congressional Review Act exists," stated Congressman Joyce. He emphasized his ongoing efforts since 2022 to protect consumer freedom and expressed his commitment to collaborating with Chairman Guthrie and Chairman Capito against what he described as an impractical mandate.

The waiver granted by the Biden Administration enables California's EV mandate under its unique status in the Clean Air Act. This decision impacts sixteen other states, including Pennsylvania, which have adopted California's standards, influencing nearly 40% of the automobile market.

Previously, during the 117th Congress, Dr. Joyce led a letter signed by 168 cosigners expressing disapproval of California’s regulation. In response, he introduced H.R. 1435, known as the Preserving Choice in Vehicle Purchases Act, designed to block electric vehicle mandates and safeguard consumer choice.

Dr. Joyce has reintroduced this act in the current Congress to continue advocating for American consumers' choices regarding vehicle purchases.

Recently, at an Energy and Commerce Committee Energy Subcommittee hearing, Dr. Joyce questioned the validity of California’s waiver from the Environmental Protection Agency concerning their extensive Electric Vehicle mandate and highlighted concerns about insufficient Congressional review or oversight.
