Pennsylvania House Republican Leader Jesse Topper and Representative Perry Stambaugh have announced plans to introduce legislation aimed at protecting student-athletes who receive compensation for the use of their name, image, and likeness (NIL). This initiative comes in response to the absence of a state legal framework, which currently leaves compensated student-athletes vulnerable to financial pitfalls and without protection if they sustain injuries during their careers.
“NIL is one of the most dynamic and evolving spaces in the national sports market that has become a life-changing positive for many student-athletes and families,” said Topper. He emphasized the need for state-level legal measures to protect student-athletes during this critical period in their lives.
The proposed legislation seeks to ensure that students have access to financial education and protection for their NIL assets. It also aims to provide them with opportunities to save earnings in case of injury or other career-ending circumstances. The proposal includes a requirement for higher education institutions to offer trust accounts where student-athletes can deposit a portion of their revenue sharing or NIL earnings. These accounts would be managed by established financial firms experienced in educational trust management.
Key features of these trust accounts include full accessibility upon graduation or departure from university, limited hardship withdrawals with oversight, professional investment management with transparent reporting, and an opt-in structure that maintains athlete autonomy while promoting responsible financial planning.
Additionally, colleges and universities would be required to provide financial literacy education and resources for their student-athletes. “In the new ‘Wild, Wild West’ of collegiate athletics that NIL has spawned, helping protect student-athletes from financial harm or exploitation is a solid first step states should take,” added Stambaugh. He highlighted Pennsylvania’s commitment to monitoring changes in the NIL landscape and enacting policies that keep its colleges competitive.
